SMS Terms

These SMS Terms (the "SMS Terms") describe the text-message programs operated by Florida Fine Cars, Inc., a Delaware corporation headquartered in Miami-Dade County, Florida ("Florida Fine Cars"), and by its operating dealer subsidiary Florida Fine Cars, Inc. ("Dealer"). They are incorporated into and supplement the Florida Fine Cars Terms of Use and the Florida Fine Cars Privacy Policy. By opting into any Florida Fine Cars text-message program, you agree to these SMS Terms.
1. Program operator and brand
The consumer-facing brand for all Florida Fine Cars text-message programs is "Florida Fine Cars". The legal sender is Florida Fine Cars, Inc., operating through its subsidiary Florida Fine Cars, Inc. Messages are sent from Florida Fine Cars-registered 10-digit long codes ("10DLC") and, where applicable, toll-free or short-code numbers registered with The Campaign Registry (TCR) and the mobile carriers. Written revocation, questions, and complaints may be sent to Florida Fine Cars, Inc., Attn: SMS Program, 21025 NW 2nd Ave, 4th Floor, Miami, FL 33169.
2. Scope — Florida Fine Cars operates four separate SMS programs
For clarity of consent, Florida Fine Cars operates four separate SMS programs. Opting into one program is not opting into any other. Each program has its own opt-in record with its own scope and its own opt-out. A STOP request in one program does not, by default, unsubscribe you from any other program — see Section 10 for the STOP mechanics, including a "STOP ALL" super-keyword that unsubscribes you from every Florida Fine Cars SMS program at once.
- Program A — Transactional (Order & Contract). Order-and-contract messages tied to a specific transaction.
- Program B — Service & Account. Account-servicing and subscription-lifecycle messages tied to your Florida Fine Cars account.
- Program C — Concierge two-way chat. Shopper-initiated conversations with Florida Fine Cars concierge, which may be human, AI-assisted, or a combination.
- Program D — Marketing & Promotional. Recurring promotional messages. Opt-in requires a separate, unchecked, single-purpose checkbox and is never a condition of any purchase or of accessing Florida Fine Cars services.
3. Program A — Transactional (Order & Contract)
Program A covers messages tied to a specific transaction, including:
- Order confirmation and updates
- Financing and F&I document-signing notices
- Delivery scheduling and ETA updates
- In-person pickup confirmations
- Price-lock expiration warnings
How opt-in works. Providing your mobile number at Buy-Path checkout or Subscribe-Path checkout, together with the transactional-SMS disclosure presented at that moment, is your prior express consent under the TCPA (47 U.S.C. § 227) to receive the Program A messages listed above at the number you provided. Consent to Program A is a condition of transaction fulfillment; without it we cannot notify you about your order.
Frequency. Event-driven. Typically up to ten (10) messages per order.
4. Program B — Service & Account
Program B covers account-servicing messages tied to your Florida Fine Cars account:
- Subscription renewal reminders
- Subscription renewal payment-declined notices
- Warranty follow-up
- Service-appointment reminders
- Financing-application status
- Safety recall notices (subject to your Recall opt-in — see Section 6 of the Terms of Use and our Safety Recall Policy)
How opt-in works. Creating a Florida Fine Cars account and providing your mobile number, together with the account-SMS disclosure at that moment, is your prior express consent to receive Program B messages.
Frequency. Event-driven. Typically fewer than five (5) messages per month for most customers.
5. Program C — Concierge two-way chat (may include AI)
Program C covers conversations you start with a Florida Fine Cars concierge by texting one of our published concierge numbers. Replies may come from a human agent, an AI-assisted agent, or a combination. When you first text a Florida Fine Cars concierge number, we send a confirmation message identifying the program, disclosing that replies may be AI-assisted, and stating the STOP and HELP mechanics.
How opt-in works. You initiate Program C by texting a Florida Fine Cars concierge number. Our reply, together with the confirmation message referenced above, is our reply to your consumer-initiated communication under the TCPA (see Facebook, Inc. v. Duguid, 141 S. Ct. 1163 (2021)). Program C consent covers only the concierge conversation itself; it is not consent to Program A, B, or D.
Recording. Concierge chat sessions may be recorded and analyzed for quality assurance, staff training, compliance, fraud prevention, and dispute-resolution purposes per Section 29 of the Terms of Use and Florida's Security of Communications Act (F.S. § 934.03).
Frequency. As initiated by you. No unsolicited outbound Program C messages.
6. Program D — Marketing & Promotional
Program D covers recurring promotional messages, including:
- Holiday and seasonal sales
- Subscription launches and program announcements
- New-vehicle-arrival alerts on your saved searches
- Price-drop alerts on your saved vehicles
- Event invitations
How opt-in works. Program D requires a separate, unchecked, single-purpose checkbox that you affirmatively check. It is never bundled with any other Florida Fine Cars consent (Program A, Program B, Program C, email marketing, account creation, or any transaction). Your consent to Program D is not a condition of any purchase, subscription, or other Florida Fine Cars service. Consent may be revoked at any time under Section 10.
Frequency. Recurring; typically up to eight (8) messages per month, though frequency varies by campaign and by your saved-search / saved-vehicle activity.
7. Message frequency
Message frequency varies by program: Program A (transactional) is event-driven, typically up to ten messages per order; Program B (service) is event-driven, typically fewer than five messages per month; Program C (concierge) is shopper-initiated; Program D (marketing) is recurring, typically up to eight messages per month. Actual frequency depends on your account activity and campaign schedules.
8. Message and data rates
Florida Fine Cars does not charge you for messages we send. Your mobile carrier's standard message and data rates may apply. Contact your carrier for details about your plan and any charges.
9. How to get help (HELP)
Reply HELP to any Florida Fine Cars number to receive an auto-reply with the program name, our support phone at 1-305-384-6400 (1-305-384-6400), our support email support@floridafinecars.com, and a reminder of the STOP mechanics. You may also contact us through the channels listed in Section 17.
10. How to opt out (STOP)
Consistent with the Federal Communications Commission Revocation Rule Amendment effective April 11, 2025, we honor the following seven per-se-reasonable opt-out keywords, plus common variants, sent by SMS to any Florida Fine Cars number: STOP, END, QUIT, REVOKE, OPT OUT (or OPTOUT), CANCEL, UNSUBSCRIBE, and also STOPALL. Any of these terminates the specific SMS program you sent it to.
"STOP ALL" super-keyword. To unsubscribe from every Florida Fine Cars SMS program at once, reply STOP ALL (as two words) or STOPALL to any Florida Fine Cars number. We will unsubscribe you from Programs A, B, C, and D simultaneously.
Other opt-out channels. You may also opt out at any time by (i) updating notification preferences in your Florida Fine Cars account, (ii) sending an email to optout@floridafinecars.com, or (iii) sending written notice to the mailing address in Section 17. We will honor an opt-out request received through any channel within ten (10) business days per 47 CFR § 64.1200, and typically within minutes.
Confirmation reply. After you opt out of a Program, we may send one confirmation SMS within five (5) minutes of receipt confirming the unsubscribe and, for non-marketing programs, providing a reminder of how to re-subscribe. This confirmation is permitted under FCC 2015 declaratory ruling on one-time non-marketing confirmations.
Program scope. A STOP request is program-scoped by default. For example, opting out of Program D (Marketing) does not stop Program A order-confirmation messages tied to a purchase you have already made. To end all messages, use STOP ALL as described above.
11. How to re-subscribe (START)
To re-join a Program you previously opted out of, reply START, UNSTOP, RESUBSCRIBE, SUBSCRIBE, or RESUME to a Florida Fine Cars number that participates in that Program. You may also re-consent through the original opt-in channel (Buy-Path checkout, Subscribe-Path checkout, account preferences, or the marketing opt-in surface).
12. Age and location eligibility
Florida Fine Cars text-message programs are open to individuals eighteen (18) years of age or older with a valid U.S. mobile number. At launch, Florida Fine Cars offers text-message services to residents of Florida. We will update this Section as we expand into additional states; state-specific addenda appear in Section 18.
13. Supported carriers and carrier disclaimer
Supported carriers include AT&T, Verizon, T-Mobile, US Cellular, Boost Mobile, Cricket Wireless, Metro by T-Mobile, and most other U.S. mobile carriers. Supported carriers may change without notice. Carriers are not liable for delayed or undelivered messages.
14. Prohibited and restricted content
Florida Fine Cars does not send content prohibited under the CTIA Messaging Principles and Best Practices — including sex, hate speech, alcohol, firearms, tobacco, cannabis, gambling, controlled substances, or fraud (the "SHAFT+" categories). You may not send prohibited content to any Florida Fine Cars number.
15. Privacy and no-sale of opt-in data
Your mobile number and SMS-program consent record are personal information governed by the Florida Fine Cars Privacy Policy. Florida Fine Cars uses SMS-messaging service providers (including but not limited to Twilio) as processors to send messages on our behalf under contract.
16. Device compatibility, program changes, number migration
A functional SMS/MMS-capable mobile device on a supported carrier is required to receive Florida Fine Cars messages. Florida Fine Cars may modify, suspend, or terminate any SMS program at any time with notice by SMS, email, or through your Florida Fine Cars account. Where we migrate sending traffic between numbers (for example, from a long code to a short code as volume grows), we will send a number-migration notice to affected subscribers at least seven (7) days before the cutover consistent with the CTIA Messaging Principles and Best Practices; the first message from the new number will re-identify Florida Fine Cars as the sender.

Dispute resolution. These SMS Terms are governed by, and incorporated into, the Florida Fine Cars Terms of Use. Section 43 of those Terms of Use contains an ARBITRATION and CLASS-ACTION WAIVER that applies to any dispute arising out of or relating to your use of any Florida Fine Cars SMS program. You may opt out of that arbitration provision within thirty (30) days of first accepting the Terms of Use as described in Section 43(i).
18. State-law addenda
The following state-specific addenda apply to consumers in the identified state and supplement (and do not replace) the sections above.
Florida
Florida Fine Cars SMS programs are operated in compliance with the Florida Telephone Solicitation Act, F.S. § 501.059, as amended by 2023 HB 761. Consent to marketing messages is captured through an unchecked, single-purpose checkbox constituting written consent under F.S. § 668.50 (UETA / Florida Electronic Signature Act) and the FTSA "signature" standard. Alleged FTSA violations are subject to the fifteen (15) day pre-suit notice and cure procedure under F.S. § 501.059(10)(b); the notice address is set out in Section 17.
